Privacy Policy

This Privacy Policy (“Policy”) describes the privacy practices applicable to ScopeRX LLC (“ScopeRX”) (“we,” “our” or “us”), including the websites, platforms, and related systems that we operate (collectively, the “Services”). The Policy explains how personal information about you may be collected, used, and disclosed by us. The Policy also explains the rights and choices certain individuals may have regarding their own personal information that is subject to this Policy.

If we have entered into agreements with you or your company and there is a conflict between this Policy and those other agreements, those other agreements will control and supersede this Policy to the extent of the conflict.

1. INFORMATION WE COLLECT

We collect and receive information about you in connection with the Services. In some jurisdictions, this information may be considered Personal Information. Personal Information means information relating to an identified or identifiable natural person, to the extent provided by applicable law. Personal Information does not include information that has been deidentified, pseudonymized, or anonymized to the extent permitted by applicable law.

  • Account Information. When you use the Services, you or your company will provide information about you, which may include your name, company name, job title, postal address, telephone number, and email address.
  • Account Credentials. When you register to use the Services, we may collect your account information, such as username and password.
  • Contacting Us about the Services. When you contact us, you may provide information such as your name and email address. For example, you may send us an email or use our contact forms.
  • Device and Browser Information. When you use the Services, we may collect information, such as the type of browser and operating system you are using, the domain name of your Internet service provider, which pages you visit or functions you use and how long you spend on each, and the unique number (such as IP address) assigned to your server or Internet connection.
  • Service Providers. We collect information about individuals associated with service providers that we engage in connection with the Services, such as name, company name, job title, postal address, telephone number, and email address.
  • Uploaded Content.Personal Information may be contained in records, documents, case materials, medical records, legal records, expert reports, pleadings, discovery materials, correspondence, deposition transcripts, and other content uploaded to or processed through the Services (“Uploaded Content”). Uploaded Content may include Protected Health Information (“PHI”), health-related information, demographic information, employment information, financial information, and other sensitive Personal Information where permitted by applicable law. Users are solely responsible for ensuring they have all necessary rights, permissions, authorizations, and legal authority to share and disclose Uploaded Content for processing through the Services. We process Uploaded Content on behalf of our users subject to agreements with those users.

You are not obligated to provide us with Personal Information in all of the cases described above. However, without your Personal Information, we may not be able to fulfill all available functions.

2. USES AND PURPOSES OF INFORMATION

We use Personal Information and other information for the purposes described below.

  • To provide the functionality and features of the Services
  • To create and manage your account on the Services
  • To respond to your inquiries and fulfill your requests
  • To analyze and improve the functionality, customization, personalization, security, design, and/or content of the Services and our artificial intelligence (“AI”) platform. Users are responsible for ensuring they have obtained all necessary rights, permissions, and authorizations to share Uploaded Content for these uses and that such uses comply with all applicable laws and contractual obligations. However, we do not use Uploaded Content to train our AI platform. When we use third party AI platforms (such as Large Language Models), we do not permit such third party AI platforms to use Personal Information or Uploaded Content for training.
  • To conduct usage analytics, including analyzing usage and patterns on the Services
  • To aggregate and/or deidentify information from you and other users of the Services
  • To provide technical support for the Services
  • To provide you with information about our products and services
  • To develop new products and services
  • To administer, fulfill and enforce contractual obligations
  • To send you marketing communications
  • For compliance purposes and legal obligations, such as complying with legal and regulatory requirements, protecting and defending us and our affiliates against legal actions or claims, preventing fraud, enforcing contractual rights, auditing, security monitoring, incident response, and protecting the security and integrity of the Services

We also process Personal Information and Uploaded Content on behalf of our customers in connection with their use of the Services. In those cases, we act as a service provider or data processor, and our customers (the data controller) are responsible for determining how Personal Information and Uploaded Content is collected and used. Where we act as a service provider or processor, we process Personal Information and Uploaded Content in accordance with our customers’ instructions and applicable agreements.

3. DISCLOSURE OF PERSONAL AND OTHER INFORMATION

We do not sell Personal Information we have collected to third parties or engage in behavioral advertising. Your Personal Information and other information may be shared with third parties as follows:

  • Personal Information and other information may be shared with third parties that we engage to provide services to us or assist with the operation or maintenance of the Services and other functions. These third parties are authorized to use your Personal Information only as necessary to provide the services to us.
  • We may share with third parties information that has been deidentified or anonymized such that the third party cannot personally identify you from the information we share.
  • If you obtained access to the Services through your company or other organization, we may share your Personal Information and other information with them to administer the account and/or our agreement with them.
  • We may share or transfer your information if we enter into a business transaction such as a merger, acquisition, reorganization, bankruptcy, or sale of some or all of our assets, or in preparation for any of these events.
  • We may disclose your information if we believe that the Services are being used to commit unlawful acts; if disclosure of your information is required to comply with applicable laws or regulations or with a court or administrative order or will help to enforce any applicable terms of use; to protect your safety or security, including the safety and security of property that belongs to you; or to protect the safety and security of the Services or third parties.
  • We may share your Personal Information with other parties based on your consent.

4. COOKIES AND SIMILAR TECHNOLOGIES

When you visit the Services, we may place, or authorize third parties to place, cookies, web beacons, and other tracking technologies on your device. These technologies help the Services operate more efficiently and improve your experience with the Services by performing functions like allowing the Services to recognize you. We also use these technologies for statistical and analytical purposes, such as counting how many unique visitors have accessed the Services and analyzing usage patterns on the Services. You may adjust your device settings to block or manage some of these technologies. However, doing so may limit some functionalities of the Services. We use Google Analytics to analyze usage of the Services. 5. YOUR RIGHTS AND CHOICES

  • Opt-Out of Marketing. If you wish to opt-out of receiving marketing solicitations from us, please contact us at the email or postal address listed in Section 12. Even if you opt-out, we may still use and share the information we collect for non-marketing purposes.
  • Unsubscribe from Emails. Our marketing emails, if any, will include an automated way for you to opt out (unsubscribe) from marketing emails sent by us. To unsubscribe, please follow the instructions in the email you receive.
  • Personal Information Rights and Choices. Subject to applicable limitations, applicable law (including laws applicable in your state of residence), and verification requirements, you may have the rights and/or choices below regarding your Personal Information. If the Services are used through your employer, we are not responsible if your exercise of these rights affects your employment.
    • Access: Confirmation of whether we process Personal Information about you and, where reasonably feasible, access to that information.
    • Correction: Request we correct or update Personal Information that is inaccurate, incomplete, or outdated.
    • Deletion: Request we delete Personal Information we hold about you. Deletion requests are subject to certain exceptions, including where retention is necessary to comply with legal obligations or retention practices, resolve disputes, enforce agreements, or protect our rights and legitimate interests.
    • Restrict, Limit Use or Object: Request we restrict or limit certain uses of your Personal Information and/or object to our use of your Personal Information, including where you believe the information is inaccurate, no longer needed, or being processed in a manner inconsistent with this Privacy Policy.
    • Withdraw Consent: Where we rely on consent to process Personal Information, you may withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing conducted prior to the withdrawal and may affect our ability to provide the Services to you.
    • Requests to exercise these options may be submitted by emailing or writing to the contact addresses listed in Section 12. We may take reasonable steps to verify your identity before responding to a request. You may have the right, depending on applicable law, to have an authorized agent submit a request on your behalf. Submitting a request will not subject you to discrimination. We will not charge a fee, unless your requests are excessive or unfounded. We may decline requests that are unreasonable, excessive, or otherwise not legally required under the circumstances. If we deny your request, you may appeal our decision by contacting us using the addresses in Section 12, and we will review and respond to the appeal within a reasonable time, including a brief explanation if the appeal is denied.
    • In some cases, we act as a service provider or data processor on behalf of our customer, who is the data controller. You should contact the applicable data controller to exercise any rights you have with respect to your information, and we may direct you to contact the customer if you contact us.

6. U.S. SCOPE

We are organized in the U.S. and the Services are intended for use in the U.S. Any information that you provide to us, including Personal Information, will be processed in the U.S. If you are located outside the U.S., please be advised that the U.S. does not offer safeguards to protect Personal Information that are as stringent as some other jurisdictions in the world.

7. DATA RETENTION

We retain Personal Information only as long as reasonably necessary to provide the Services, satisfy contractual obligations, comply with applicable legal requirements, resolve disputes, enforce agreements, and protect our legal rights. Unless a longer retention period is required by law or contract, customer content will generally be retained during the active subscription period and for up to two (2) years following account termination to permit recovery or export of customer data. Thereafter, such information will be deleted or de-identified in accordance with our internal retention and deletion procedures.

8. SECURITY

Although we employ technical and organizational controls that we believe are reasonably appropriate to protect your information, we do not guarantee that our security precautions will protect against the loss or misuse of your information. Similarly, we cannot guarantee the privacy of information you transmit over the Internet or that may be collected in transit by others, including contractors that provide services to us.

9. OTHER WEBSITES AND LINKS

The Services may contain links to other websites. We are not responsible for the information collection or privacy practices of other websites. You should consult the privacy policies of other websites before you visit those websites or provide any information to those websites.

10. MINORS

You must be at least 18 years old, or the age of majority in your jurisdiction to enter into a contract, whichever is older, to use the Services. The Services are not designed to identify or target minors. However, if you become aware that we have collected Personal Information from a minor and you are the minor’s parent or guardian, please notify us at info@scoperx.ai and we will review the circumstances of the collection.

11. REVISIONS TO THIS POLICY

We reserve the right to revise this Policy at any time. Please review this Policy periodically for changes and at any time you provide information to us. We will also notify you if we make material changes to the Policy by posting a notice on the Services or contacting you by other methods. By continuing to access or use the Services after changes become effective, you agree to be bound by the terms of the revised Policy.
